Contents
1.General
The website and all online services offered through it (the "Site") are operated by Israeli Jazz Council (registered non-profit association) (the "Association"). These terms (the "Terms") apply to any use of the Site: browsing, opening an account, buying tickets, donating, applying for membership and using the personal area.
Using the Site means you accept the Terms. If you do not accept them, please do not use the Site.
The Terms supplement the documents that apply to each kind of activity: the Privacy Policy, the Ticket Purchase and Cancellation Terms, the Membership Terms, the Donation Policy and the Association Bylaws. Where a specific document governs a matter, that document prevails.
The Hebrew text uses gender-neutral language where possible; any gendered wording refers to all genders.
2.About the Association
The Association is a non-profit association registered under the Associations Law, 5740-1980, working to promote jazz in Israel. Its details and contact information:
- Name
- Israeli Jazz Council (registered non-profit association)
- Address
- Tel Aviv, Israel
- Phone
- 052-258-0547
- Website
- jazz.ross-developers.com
3.Services on the Site
Through the Site you can, among other things:
- read about the Association and its activities, events and articles;
- buy tickets to events, subject to the Purchase and Cancellation Terms;
- apply to join the Association, sign the application electronically and manage your membership, subject to the Membership Terms and the Bylaws;
- make a one-time or monthly donation, subject to the Donation Policy;
- appear in the public members directory and on the donor wall, if you choose to;
- sign up for news and mailings and manage your notification preferences in the personal area.
The Association may change, extend or discontinue parts of the Site and its services, provided this does not affect rights already acquired, such as a ticket bought or a membership period paid for.
4.User Accounts
Some services require an account. The details you give must be true, complete and up to date, and you must update them when they change. Your account is personal and may not be transferred.
You are responsible for keeping your password and verification methods secret, and for everything done in your account. We recommend turning on two-step verification in your security settings. If you suspect unauthorised use, tell the Association at once at info@jazzcouncil.org.il.
Where available, you can sign in with a Google account. Google then passes your name, email address and profile picture to the Association, and Google's own terms and policies also apply.
The services are intended for people aged 18 and over. A minor may use the Site and buy tickets with the consent of a parent or guardian. Membership of the Association is open from age 17, as section 15 of the Associations Law provides.
The Association may suspend or block an account used in breach of the Terms or the law, or where there is a real concern of fraud or a security risk. For members of the Association this does not override the Bylaws or section 16 of the Associations Law, under which a member may be expelled only on grounds set out in the Bylaws and after a fair opportunity to be heard.
You can ask to close your account at info@jazzcouncil.org.il. Information the Association must keep by law, such as receipts and the register of members, is kept after the account is closed, as described in the Privacy Policy.
5.Acceptable Use
Use the Site reasonably, in good faith and lawfully. Among other things, you may not:
- use the Site unlawfully, or in a way that harms the Association, other users or third parties;
- try to break into its systems, bypass security measures or access restrictions, or run malicious code;
- collect or copy information from the Site by automated means (such as scraping or crawling), including details from the members directory;
- use the details of members, donors or other users to send them advertising or approaches they did not ask for;
- impersonate anyone or misrepresent your identity or any connection with the Association;
- upload content that is offensive, threatening, discriminatory, defamatory, invades privacy or infringes anyone's rights;
- disrupt the Site or place an abnormal load on it.
Where the Site is misused, the Association may remove content, reverse an action or restrict access, in addition to any other remedy available by law.
6.User Content and the Members Directory
Members and donors may upload content such as a photo, biography, links, education and work details, and documents ("User Content"). By uploading it you confirm that you own the rights in it or have permission to upload it, and that the people who appear in it have agreed.
By uploading User Content you grant the Association a non-exclusive, royalty-free, worldwide licence to store, display, copy and resize or reformat it as needed to run the Site and its services. For content you chose to make public, the licence also covers showing it in the members directory and in the Association's publications about its activities. The licence ends when the content is deleted or when you ask for it to be removed, except for copies in backups until they are rotated and for publication that has already taken place. The author's moral rights are preserved.
Appearing in the public members directory and on the donor wall is optional: everyone decides whether to appear and which details are shown, and may change their mind at any time in their profile settings. The Association may hide an entry or content from the directory, but will never list anyone who has not agreed.
The Association does not review User Content in advance and is not responsible for it, but may remove content that breaches the Terms or the law.
If you believe content on the Site infringes your rights, write to info@jazzcouncil.org.il stating where the content appears, which right you claim and how to reach you. The Association will review the notice and promptly remove content found to be infringing.
7.Intellectual Property
The Site, its design, texts, logo, images, recordings and other content published by the Association are protected by copyright and other intellectual property rights belonging to the Association or to third parties who have allowed it to use them.
You may view and print the content and share links to it for personal, non-commercial use, and make fair use of it within the meaning of section 19 of the Copyright Law, 5768-2007. Any other use, including copying, distribution, modification or commercial use, requires the prior written consent of the Association or the rights holder.
Third-party names, marks and logos on the Site belong to their owners.
8.Third-Party Services and Links
The Site uses third-party services, including the payment company's secure payment page, Google sign-in, and embedded YouTube and Spotify players that load only when you click them. These services are subject to their operators' own terms and privacy policies, and the Association is not responsible for their content or availability.
9.Liability
The Association works to keep the information on the Site accurate and up to date and the Site available and secure. Even so, faults, maintenance breaks, disruptions and mistakes may occur. Event details, including dates, performers and prices, may change; the details that bind a transaction are those shown when it was made and sent in the order confirmation.
To the fullest extent the law allows, the Association is not liable for indirect or consequential loss arising from use of, or inability to use, the Site. This does not limit the Association's obligations under the purchase, membership and donation documents, consumer rights under the Consumer Protection Law, 5741-1981, or any liability that cannot lawfully be limited.
10.Privacy and Messages
The Association uses personal information as described in the Privacy Policy.
Service messages, such as order confirmations, tickets, receipts, updates about an event you bought tickets for and membership renewal notices, are sent as part of the service. Advertising and donation requests are sent only as section 30A of the Communications (Telecommunications and Broadcasting) Law, 5742-1982, allows; they are labelled as such and include an easy way to opt out. You can manage your preferences in your notification settings at any time.
11.Accessibility
The Association works to make the Site and its services accessible to people with disabilities. Details, and how to request an accessibility accommodation, are in the Accessibility Statement.
12.Changes to the Terms
The Association may update the Terms from time to time. The date of the last update appears at the top of this document. A material change will be announced on the Site, and to account holders by email or in the personal area, where possible before it takes effect.
A transaction, donation or membership application is governed by the terms in force when it was made.
13.Governing Law and Jurisdiction
The Terms and the use of the Site are governed solely by the laws of the State of Israel. Disputes will be heard by the competent court in Israel under the ordinary rules of jurisdiction, including the small claims court.
The Association encourages you to contact it first with any claim or question, so that the matter can be settled by agreement.
14.Contact
Send questions about the Terms to info@jazzcouncil.org.il, call 052-258-0547 or use the contact form. To cancel a transaction, see the Cancel a transaction page.
